Terms of Service
1. Who we are
Petty is operated by Parkfarley SAS, a société par actions simplifiée registered in France.
- Company: Parkfarley SAS
- SIREN: 989 098 165
- Registered address: 3 rue Cunin-Gridaine, 75003 Paris, France
- Contact: staypettyai@gmail.com
By creating an account or using Petty, you agree to these Terms. If you don't agree, please don't use the app.
Petty is available on the App Store under the name Stay Petty. These Terms apply to both.
2. What Petty is
Petty is a mobile app for couples to share and track household tasks, earn points and run weekly challenges, and submit disagreements ("disputes") to an AI mediator, for non-binding evaluations.
Petty is currently in beta. Features may change, break, or be removed as we improve the app.
3. Eligibility
You must be at least 18 years old to use Petty. By using Petty, you confirm you meet this requirement. Petty is designed for two adults sharing a household. A household is limited to two users.
4. Your account
You are responsible for keeping your password secure, all activity under your account, and notifying us if you suspect unauthorized access. You agree to provide accurate information when creating your account and to keep it up to date.
5. Your content
You retain ownership of the content you create in Petty (task names, check-ins, dispute text, feedback, etc.). By using the Service, you grant us a limited, non-exclusive, royalty-free license to host, store, process, and display your content solely for the purpose of operating Petty for you and your partner.
We will not use your content for advertising, sell it to third parties, or use it to train AI models.
6. Disputes and AI-generated content
Petty includes an AI mediator that evaluates disputes you submit.
- The disputes feature uses artificial intelligence powered by a third-party language model (currently OpenAI's GPT models).
- Dispute responses are generated automatically and are not legal, professional, medical, or therapeutic advice.
- Dispute evaluations are non-binding. They are intended for entertainment and lighthearted mediation, not for resolving serious disputes.
- Petty may produce responses that are incorrect, biased, inappropriate, or unexpected. We do our best to prevent this but cannot guarantee the quality or content of the output.
- You should not rely on the disputes feature for any decision with real consequences. Use your own judgment.
By submitting a dispute, you agree that:
- The dispute text will be sent to OpenAI for processing (see the Privacy Policy for details)
- You accept dispute responses are for entertainment and informal mediation only
- Parkfarley is not responsible for any outcome based on dispute responses
7. Acceptable use
You agree not to use Petty for any unlawful purpose, submit harassing, hateful, threatening, or sexually explicit content, try to hack or disrupt Petty's systems, reverse engineer the app, use automated tools to interact with Petty, impersonate someone else, use Petty to harass your partner, or attempt to manipulate AI-generated dispute responses into producing harmful, illegal, or offensive output.
We may suspend or terminate your account if you violate these rules.
8. Beta service
Petty is currently in beta. The app may have bugs, broken features, or unexpected behavior. We may make significant changes to features at any time. The Service may be unavailable due to maintenance or technical issues. Data loss, while unlikely, is possible in a beta product. By using Petty during beta, you accept these limitations.
9. No warranty
Petty is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and warranties that the Service will be uninterrupted or error-free, and warranties about the accuracy, reliability, or completeness of any content, including AI-generated dispute responses.
This does not affect your statutory rights as a consumer under French and EU law.
10. Limitation of liability
To the maximum extent permitted by law, Parkfarley shall not be liable for any indirect, incidental, consequential, or punitive damages, any loss of data or business opportunities, any harm arising from your use of or reliance on AI-generated dispute responses, or any disputes between you and your partner.
Our total liability to you is limited to the greater of: (a) the amount you have paid us in the 12 months before the claim, or (b) €50.
This limitation does not apply to liability for death or personal injury caused by our negligence, liability for fraud, or any liability that cannot be excluded under French or EU law.
11. Termination
You can terminate your account at any time by deleting it from within the app (Profile → Settings → Delete Account). We may terminate or suspend your account if you violate these Terms, misuse the Service, we are required to do so by law, or we discontinue the Service.
12. Discontinuation of the Service
We may decide to discontinue the Service at any time. If we do, we will give you reasonable notice (at least 30 days where possible) and provide a way for you to export your data before the Service shuts down.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email at least 30 days before the changes take effect. Continued use of Petty after the changes take effect means you accept the updated Terms.
14. Privacy
Your use of Petty is also governed by our Privacy Policy, which explains how we collect and handle your personal data.
15. Governing law and disputes
These Terms are governed by French law. If you are a consumer, nothing in these Terms limits your statutory rights under French, EU, or other applicable consumer law.
Before starting a formal dispute, please contact us at staypettyai@gmail.com so we can try to resolve it informally.
For users outside the United States
If we cannot resolve a dispute informally, EU residents may use the European Commission's Online Dispute Resolution platform. Disputes will otherwise be submitted to the competent French courts.
For users in the United States
Binding arbitration. Any dispute arising out of or relating to these Terms or your use of Petty that cannot be resolved informally will be resolved through final and binding individual arbitration, not in court. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and may be conducted remotely or in your county of residence.
Exceptions. You may bring an individual claim in small claims court if it qualifies. Either party may also seek injunctive or equitable relief in court to protect intellectual property rights.
Class action waiver. You and Parkfarley agree that any dispute will be brought in individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate claims from multiple users.
Opt-out right. You can opt out of this arbitration agreement by sending written notice to staypettyai@gmail.com within 30 days of first accepting these Terms. Your notice must include your full name, email associated with your Petty account, and a clear statement that you wish to opt out of arbitration.
Severability. If the class action waiver is found unenforceable in a particular case, the arbitration agreement will not apply to that case, and the dispute will proceed in the competent courts described above.
16. Miscellaneous
- Entire agreement: These Terms (together with the Privacy Policy) are the entire agreement between you and Parkfarley regarding Petty.
- Severability: If any part of these Terms is found to be unenforceable, the rest remains in effect.
- No waiver: If we don't enforce a right under these Terms, that doesn't mean we've waived it.
- Assignment: You can't transfer your account or rights under these Terms. We may transfer our rights as part of a sale or restructuring.
